Last weekend I had a bit of spare time waiting in the CC club house so I decided to have a good walk around. Its such a shame that there is so much space that never gets used such as kiddie car track, golf things etc. The gym is poor for the amount of people who want to use it. Perhaps its time for the place to have a bit of a face lift? How would the residents of ALL phases help the MO decide what their customer really need? There is money in the bank (our money) as per the ballance sheet, so why can't we improve the place?  Vince

I have been making suggestions for years on improvements to the clubhouse, but they are always met with the usual bullshit letter from MO thanking me for my suggestions - and nothing gets done about it ! It is so stupid that the biggest space in the clubhouse is a pathetic grass ski hill that is only opened every second weekend - and on that weekend the kids have no access to their playroom and the door usually stays locked because no-one uses the ski hill (and if they do they risk hurting themselves on the plastic sleds which are broken and will seriously injure a child one of these days) The gym is way too small for the amount of people that live in CC, the so-called squash courts are never opened and what the hell is the deal with the "cafe" ?

You're right! Gym is dark, small, unhygienic and like a sauna because it doesn't have dedicated air con. Machines lie broken for weeks. Rest of facilities are mainly architect and developer sales tools which no one really wants or uses. I had suggested relocating the gym to ski slope so a/c wouldn't be a problem and the area would be soundproof and much larger. Ski slope could move to gym if demand dictated? Nelson Chan, Head MO said it can't be done as Owners haven't taken building over from Developer. Sounds a load of crap to me because on the accounts we have been losing millions every year supporting the so called facilities no one wants. Whatever we need a consumer survey of what people want and then set about doing it. It may cost short term but more people will use the place and revenue will increase. Just wasting money every year maintaining a white elephant is typical MO easy option.

to do with MO, we must have strong people with leadership, and know how to deal with them, know their weaknesses, and have the ability to find out those things they may have done wrongly too. Otherwise, they will only reply our demand with those meaningless letters and nothing done after another 5 years...

Doesn't matter how strong you are because they always have that pathetic excuse up their sleeve so they don't have to do anything. They have no interest in making CC a better place for residents - you can suggest/debate/argue/threaten/yell and scream until you're blue in the face - they just fall back on the "we can't change anything that deviates from the original plan" crap.
It's like banging your head against a brick wall dealing with them.

Right in principle Fust but as you say impossible in practice. I've adopted the sniper approach. Forget the monkeys and go for the organ grinder. Select a fat target from the MO pack and write to them directly. Put them on the spot and when they bluster or better still lie, in written form, send copies to his superiors at MTRC highlighting their deceit and lack of professionalism. It works if you are tenacious and don't just accept the "thanks for comments which have been noted" crap. We may not be able to bring the regime down at the moment but we can certainly cull a couple. That's the mass psychological fear of a sniper. They don't know where the shooter is or who he has his sights on. They just see people falling around them and fear they could be next. If nothing else it's amusing to watch them scurry around quicker  Certainly stops the bullshit excuses when they have to commit them to paper.

Good one Icarus .. I like that approach .. might be time to go and rev them up again. I also find it amusing when you go to the MO and ask to speak to someone .. and they're out the back motioning the receptionist to tell you they're not there ... only they don't realise you can see them in the reflection of the glass door !!!

You dont need 51%, just a concensus from the Owners committee, But firing them is not as a good an idea as working with them, That should be easier once we have committees from all four Phases. If you feel strongly enough you should talk to your commitee or even run for it.

actually, 30% is enough to fire them, but firing them may not be the best way, but certain it can be the last way should they never improve anything. btw, we found tons of problems about MTRC, we are doing many appraches to deal with MO of SVC now and possibly take them to court one day. I know many media people and LC councilors too, one day they may become helpful for us. One day when the chance and timing is right, I would love to work together with more CC friends to improve our environment and deal with MO too. Thanks.

If you feel strongly enough you should talk to your commitee or even run for it. in legal power terms, OC is very lack of power, same as DOC which our 3-4 phases of OCs are forming now, but it is still good to officially represent our residents to deal with the MO. A strong, expreienced, well-socially-connected OC/DOC can still do a lot influence to MO and MTRC.

If you read Section H of the DMC you will see the termination of Managers requires a special resolution of at least 50% of the owners shares. Unless there is another document that I don't have and supersedes this a consensus is not enough.
The DMC is a very reasonable document and properly applied by a legal or cunning mind gives the OC lots of power to reign in MO. Read the rules carefully and start playing them at their own game. The power is there to control their budgets and limit their power to dictate unilaterally.
Pick battles big enough to matter but small enough to win.

to form an IO requires 30%, and OI can fire MO. OC/DOC has some power but still not enough to deal with MO at this moment, and DMC is drafted by the developer/KC/MTRC/MO, it has a lot of terms unfairly protecting MO. anyway, I am sure many people unhappy with MO in terms of their management quality, purchase process, cost control, comment response, and much more problems in detailed level, which may affect owners rights in terms of $10-20 millions or more. One day if I am lucky enough not to sell my CC flat, I may try to work with our OCs to deal with our "lovable" MO. I hope residents from CC can support me later. Thanks.

Jefflam, Could you tell me where you have got these authorities from so I can get a copy? I can't see how it can be done as the DMC is very specific on this point but I will ecstatic if what you say is correct.
What is the OI you refer to?
